A Hart County prosecutor says state charges against a man accused of placing glass shards in cups that were scheduled to be sent to fast food restaurants have been dismissed so that federal charges may proceed.

The Hart County Commonwealth Attorney's Office said charges against 42-year-old Waylon Horton, of Munfordville, were dismissed so the federal case could move forward without interference, according to The Associated Press. The charges were dismissed without prejudice, indicating the charges can be re-filed in state court.

Horton had faced 139 counts of first-degree wanton endangerment and 139 counts of possession of a destructive device; in federal court, he's charged with one count of consumer product tampering.

Horton committed the crimes when he was employed by Dart Container in July of last year. According to the U.S. Attorney’s Office, there is video surveillance of Horton committing the acts on July 11 and July 13, 2016.

He faces up to 10 years in prison and $250,000 fine if convicted. He has pled not guilty to the charges.

Horton was released from the Hart County Jail on a $25,000 unsecured bond.
