Leitchfield Utilities Commission approves revised on-call policy for employees

At Thursday night’s Leitchfield Utilities Commission meeting, commissioners approved a new on-call policy for utility employees.

The new on-call police was written because the commission was advised by its legal council that it needed to adopt an on-call policy to assure compliance with the Fair Standards Act of 1938, due to the utility requiring maintenance shop employees to be available for on-call duties on a rotating basis after regular utility hours

Crafted by Utilities Attorney David Vickery, the ordinance states:

The Utility Superintendent or designee shall select a minimum of two Utility Maintenance Shop employees for a week of being on-call outside regular hours, on a rotating basis. The “On-Call” employee is required to carry a cell phone with him or her always, or be available to respond to the listed land line phone, and while “On-Call,” remain within 30 minutes (of) travel time of the Utility Shop. Employees will be compensated for “On-Call” time by receiving a minimum of four hours of overtime for the week spent “On-Call,” regardless of actual time worked. The “On-Call” employee shall be paid for the actual time worked less the minimum four hours paid for being “On-Call.”

The policy goes into effect on May 5, 2018, and will be listed in the revised Personnel Policies and Procedures of the city of Leitchfield and the Leitchfield Utilities Commission.
