Leitchfield City Council votes down rezoning request by narrow margin

A rezoning request from developer Randy Carter to have the property at 1955 Beaver Dam Road rezoned from R1 — single family low density — to C1 — highway business — was shot down by the Leitchfield City Council at last night’s meeting.

Carter has said he wishes to purchase the property and build an assisted living facility on the 10 acres, but he presented no development plan to the Planning Commission; the Planning Commission then voted to rezone the property to B1 (neighborhood business) instead of C1, because of the more restrictive language of B1.

City council members followed the Planning Commissions lead by voting 3-2 to rezone the property to B1 — Kelly Stevenson, Margaret Fey and Margie Decker voted to rezone to B1, while Harold Miller and Rick Embry voted nay. Tootie Cottrell abstained as his company, Agency 1, holds the listing on the relevant property.

While the B1 zoning classification allows for an assisted living facility to be built, and does not restrict the size of the facility, for unknown reasons Carter, who has not appeared at either city council meeting where the zoning request has been discussed, has apparently told the land’s seller, Lois Givens, that he will not purchase the land if it’s zoned B1.

City Council members have the final word in zoning requests.
