Murder charges have been filed against a northern Kentucky man responsible for a head-on collision that killed five members of a young family on October 26.

Kenton County Commonwealth’s Attorney Rob Sanders told news outlets on Thursday that 57-year-old Daniel Greis, of Independence, is facing five counts of murder stemming from the crash. Greis was legally intoxicated, as he had blood-alcohol level between .082 and .092, at the time of the crash, according to earlier reports. He admitted under questioning that he consumed alcohol and marijuana earlier in the day as he played golf.

Sanders said the police investigation revealed that Greis was attempting to pass another vehicle in a no-passing zone on Staffordsburg Road, in Independence, when he crashed his Honda SUV into the vehicle carrying the victims.

Sanders said the death penalty wasn’t an option since Greis didn’t intend to kill anyone.

Killed were 26-year-old Rodney Pollitt Jr., 27-year-old Samantha Malohn and their three children, nine-year-old Cailie Pollitt, eight-year-old Brenden Pollitt and six-year-old Hailieann Pollitt.
