Legislation would allow Kentucky employers to discriminate against smokers

A bill pre-filed with the General Assembly would allow employers to discriminate against smokers.

The legislation Sen. John Schickel, a Republican from Union (in Boone County), pre-filed aims to remove protections against employment discrimination based on whether a worker is a smoker.

Currently, Kentucky Revised Statutes (KRS) requires smokers be protected from discrimination. KRS also protects people from discrimination because of their race, color, religion, national origin, sex, age, or because the person is a qualified individual with a disability.

Schickel’s bill, though, would allow employers to lawfully refuse to hire or terminate a person who smokes.

The General Assembly reconvenes in January.
