
Grayson County Fiscal Court has adopted a right of way ordinance.
On Tuesday, magistrates approved the ordinance that, along with Kentucky Revised Statute (KRS) 178.040, sets the minimum right of way for all county roads at 15 feet from the center line of the road.
KRS also empowers the removal of all obstacles from a county road right of way when such obstacles become a traffic hazard.
The ordinance approved by magistrates reads as follows:
Regulations:
- The owner of any parcel of land that contains property within the minimum right of way of any county road … shall not place any obstacle[s] or allow any obstacle[s] to remain within the minimum 30 foot right of way (15 foot right of way from the centerline of the roadway) of that county road.
- After the owner of such property is notified by any county representative of such an obstacle[s], the owner of such property shall have 14 days in which to remove the obstacle[s].
- After the 14 days, the owner of such property may be cited for separate violations for each obstacle and each day in violation. A violation of this ordinance shall be penalized
Definition:
- Obstacle[s] include buildings, parked motor vehicles (running or otherwise), garbage, furniture, stacks of wood, debris, posts or any items which may exist in the county road right of way.
- Obstacle[s] do not include the following property: properly placed mailboxes, necessary utility company equipment, county signage. Further, obstacle[s] do not include fences, posts or trees existing in the right of way prior to the date of the passage of this ordinance.
Penalty:
- Any person who violates the provision of this ordinance may, upon conviction, be fined from $100 to $500 for each violation.
The ordinance goes into effect immediately.
