Leitchfield man accused of third-degree rape, being a persistent felony offender

A Leitchfield man previously granted shock probation has been accused of third-degree rape in Breckinridge County.

Bryce P. Basham, 30, was indicted earlier this month by a Breckinridge County Grand Jury on two counts of third-degree rape and first-degree persistent felony offender.

The pertinent law, Kentucky Revised Statute 510.060, states in part: “A person is guilty of rape in the third degree when: (a) Being twenty-one (21) years old or more, he or she engages in sexual intercourse with another person less than sixteen (16) years old; (b) Being at least ten (10) years older than a person who is sixteen (16) or seventeen (17) years old at the time of sexual intercourse, he or she engages in sexual intercourse with the person; (c) Being twenty-one (21) years old or more, he or she engages in sexual intercourse with another person less than eighteen (18) years old and for whom he or she provides a foster family home as defined in KRS 600.020.”

Basham, according to the Kentucky Department of Corrections, was convicted on December 2, 2021, for second-degree assault. On May 5, 2022, he was convicted of first-degree promoting contraband. Both convictions came in Breckinridge County.

His “supervision begin date” is listed by the Kentucky Department of Corrections as January 19, 2022, which falls between his two felony convictions, indicating Basham was apparently granted shock probation following his December 2021 conviction for second-degree assault.

Basham, according to the online records, was also arrested in Breckinridge County in January 2021 and charged with second-degree unlawful imprisonment and first-degree wanton endangerment. In July 2016, he was arrested in Breckinridge County and charged with first-degree wanton endangerment.
