
A commonwealth’s attorney has cited a Kentucky Revised Statute (KRS) in determining not to prosecute a Wolfe County woman for fetal homicide.
Melinda S. Spencer, 35, of Campton, was arrested and charged by Kentucky State Police with fetal homicide on December 31 after she told workers at United Clinic’s of Kentucky “that she had aborted her pregnancy at her residence on Flat Mary Road.” She was indicted on the fetal homicide charge, among other counts, on Tuesday.
Spencer told detectives that she ordered medication online to complete an abortion. Authorities found what was described by Kentucky State Police as a “developed male infant” buried in a shallow grave on Spencer’s property.
Wolfe County Commonwealth’s Attorney Miranda King said in a press release that KRS 507A.010 protects a woman from facing prosecution for causing the death of her unborn child.
“I sought this job with the intention of being a pro-life prosecutor but must do so within the boundaries allowed by the Kentucky state law I’m sworn to defend,” King said. “I’m thankful for the investigative work of the Kentucky State Police on this case. I am also grateful to the dedicated citizens who served on the grand jury and thoroughly reviewed this case.”
Spencer still faces abuse of a corpse, tampering with physical evidence and concealing the birth of an infant charges. She’s lodged in Three Forks Regional Jail.
