A 75-year-old Elizabethtown man has been accused of molesting a girl younger than 12 nearly two years ago.
The Elizabethtown Police Department arrested Marshal L. Miller last week and charged him with first-degree sodomy (victim younger than 12), a class A felony.
The arrest arose when a female juvenile visited Miller’s residence looking for a Popsicle, according to The News-Enterprise. When Miller and the juvenile were on his back porch, he allegedly sexually assaulted the victim.
The alleged incident took place in July 2024.
The victim was evaluated at Baptist Health Hardin where a sexual assault kit was performed. The Kentucky State Police laboratory said the results of testing showed that the suspect’s DNA was located on swabs taken during the sexual assault kit.
Miller was lodged in the Hardin County Detention Center but has since posted a $25,000 bond.
According to online records, Miller was arrested in March 2016 in Elizabethtown and charged with first-degree attempted rape and first-degree sexual abuse (victim younger than 12). According to The News-Enterprise, he was found not guilty of the charges.
